(Australia) -- Protesters today applauded a decision which will see a concrete batching plant built with lower silo tower heights at Kunda Park industrial estate.
But the decision will almost certainly be challenged in court, dismayed councillors said after the resolution.
An application by Boral, which would have injected $2.2 million into the economy and create 37 jobs was passionately debated.
But in the end a 5-4 vote of councillors downed a rescind motion by planning chair Vivien Griffin which sought to reverse the previous decision and approve the larger plant.
The vote came after a
heated row over conflict of interest claims.
Protesters feared if the Boral application got through unscathed, it would open the door to an asphalt plant being approved on the site, despite it already having been rejected.
Local councillor Ted Hungerford argued the silo heights at 23 metres went against the town plan which generally allows only 15 metres.
