Cemex Construction Materials has asked for a hearing before the state of Florida Division of Administrative Hearings challenging the adoption of plans for the massive Wellness Way development outside Clermont.
This is the second petition the global building materials company filed against the plan, which is expected to transform 15,481 acres in the southeast corner of the county into a hub for homes, high-tech health care jobs and other industries.
The challenge will force Lake County to put on hold its plans to seek development proposals for the property. When the county first approved the project in August 2015, Cemex filed its first petition with the division of administrative hearings demanding that the the plan acknowledge natural resource-based operations, including mining, as a permitted use.
In its new challenge, Cemex argues that the Wellness Way Area Plan does not provide “objective criteria to govern the review for conditional use permit for mining within the Wellness Way planning area.”
Cemex says that while the plan is in an urban service area it is not supported by central water and sewer already in place. There are also transportation problems in the plan, according to the petition.
“Wellness Way is not supported by a long-range transportation map or capital improvements,” Cemex attorney Roger Sims wrote.
