MSHA to hold public hearings on changes to civil penalties rule

The US Mine Safety and Health Administration will hold public hearings on its proposed changes to the civil penalties rule December 4 and 9.  

The hearings will be held in Arlington, Va., and Denver, Colorado.  

The National Stone, Sand & Gravel Association will provide testimony at both hearings.

The association is “very concerned” with the proposed rule because it would undercut the ability of operators to seek relief from the Federal Mine Safety and Health Review Commission in contesting alleged violations.  The changes will also increase penalty assessments.

The association  will circulate final comments to members after the public hearings and asks that members use these as a basis for member input.  MSHA’s deadline for receipt of post-hearing comments is Friday, January 9, 2015.
