Rogers Group to fight for Tippecanoe quarry

Rogers Group that sued the Tippecanoe County , Indiana, commissioners over a proposed limestone quarry project along the Wabash River says it disagrees with a judge’s ruling saying they acted legally when they passed an ordinance blocking it.

Nashville, Tennessee-based Rogers Group said it’s reviewing its legal options.
The ordinance passed last year blocked a quarry planned near the town of Americus a few miles northeast of Lafayette.

The lawsuit filed in January alleged that the county commission didn’t have power to pass an ordinance banning the quarry, that the county had violated Rogers Group’s mineral rights by passing the ordinance, and that the county had taken land owned by the company for public use without just compensation.
